Legal Basis.

Committees for Equal Opportunities must be instituted at all universities (comp. 42 Sec. 1 Laws Governing Universities).

 

The Federal Equal Treatment Act (B-GlBG) is to be applied to all members of the university as well as to all applicants to the university seeking employment as well as to students enrolling at the university.  Discrimination based on sex, including any related harassment in connection with employment or education or related to access to studies is prohibited (§§ 4ff B-GlBG). Similarly, discrimination based on ethnic characteristics, religion, personal beliefs, age, or sexual orientation is prohibited (§§ 13ff B-GlBG).  In accordance to statutes as stated in §§ 11ff B-GlBG regarding the hiring, career advancement and education and continual education for women and in an effort to support career advancement for women, in the event of equal qualifications, the university is obligated to hire or promote a women. All institutions at the university are required to support the Plan for the Advancement of Women.

The ST FFP and AKG will serve to concretize and expand the AKG’s legally allocated activities. Moreover, there are individual AKG relevant legal foundations in statutes governing professorship appointments, statutes governing post-doctorate procedures, statutes governing election regulations for the election of members and alternate members in collegial bodies as well as the company agreement “Guidelines for the Content and Modalities to Conclude Qualification Agreements” including guidelines.

The university should strive to support equality between men and women by enacting and implementing an Affirmative Action Plan (§ 41 UG). The Committee for Equal Opportunities is entitled to create the proposal for the plan for the advancement of women (§ 44 UG).  In this regard, the University Senate adopted statutes of the Plan for the Advancement of Women, including a compilation by the Committee for Equal Opportunities (ST FFP and AKG).

The sections of the Plan for the Advancement of Women and the Committee for Equal Opportunities will serve to concretize and expand the Committee for Equal Opportunities' legally allocated activities. Moreover, there are individual Committee for Equal Opportunities-relevant legal foundations in statutes governing professorship appointments, statutes governing post-doctorate procedures, statutes governing election regulations for the election of members and alternate members in collegial bodies as well as the company agreement “Guidelines for the Content and Modalities to Conclude Qualification Agreements”.
